CHARTER TERMS AND CONDITIONS

1 - PAYMENT TERMS

 

The payment of the daily charter includes the rental of the vessel, its belongings and electronic equipment. There will also be a cleaning fee, mandatory insurance and a deposit to cover minor damages to the vessel.

 

- Payment of 50% of the agreed amount as a reservation deposit. The contract will be digitally signed and the inspection term will be signed on the date of shipment;

 

- Payment of the remaining 50%, must be made via bank transfer, 2 days before the date of departure. In the case of foreigners, the balance can be made on the credit card or in kind on the date of departure. We don't work by check;

 

- Engine time will be charged on the outside. The hour meter is marked on departure and arrival and the adjustment is made in the store at the end of the charter;

 

- Payment of the skipper, when applicable, must be settled directly with the skipper at the time of boarding, in cash or bank transfer.

2 - SECURITY DEPOSIT

 

The amount of R$ 5,000.00 was established as a deposit for overnight charter and R$ 2,000.00 for Day Charter.

 

The security deposit must be paid by the client before boarding. The security deposit is accepted in cash or by credit card.

 

In case of loss or defect caused by the customer of any vessel's equipment, the company will retain the corresponding amount for the execution of the repair or purchase of the damaged or lost asset.

 

The security deposit will be returned in full, in case of no damage or defect in the vessel caused by the customer, verified after his return to the base of the Delta Yacht Charter.

3 - OBLIGATIONS OF THE COMPANY

 

The vessel will be delivered with all its belongings and electronic equipment ready for use, without any operational defect, clean and dry, with full water and fuel tanks, lubricating oil and engine cooling water tanks, as well as filters in good condition.

 

The company will do its best to arrange for the repair or exchange of any equipment that will suffer damage during the period of the charter. Damage caused by the customer will be charged for the displacement of the rescue team.

4 - CUSTOMER OBLIGATIONS

 

After receiving authorization to leave the company's base, all expenses related to mooring in marinas, fuel and water costs, cleaning the boat, must be paid by the customer.

 

Any accidents or damages involving the vessel, its belongings and electronic equipment during the charter period, must be immediately reported to the Delta Yacht Charter base.

 

The customer is obliged, under penalty of immediate cancellation of the charter, to remain in the designated limit area according to the marking on the nautical charts and on the map of the room at the company's headquarters.

 

Sailing and sailing or motoring at night is prohibited, except in an emergency.

 

The customer must undertake to respect all regulations and rules to maintain the vessel, its belongings and electronic equipment in perfect condition, as well as to navigate and operate the vessel responsibly and in accordance with Brazilian navigation standards (NORMAN 3).

 

The client, or qualified crew member, designated by him, must confirm, be familiarized and used to the knowledge of sailing and motor sailing of vessels of this size and be carrying a valid license. If the customer, until the moment of boarding, does not present a valid license, the company reserves the right not to deliver the vessel to the customer to make the charter without the hiring (by the customer) of a skipper. In case of cancellation for this reason, the company will not refund the amounts already paid.

 

The customer must be aware that he cannot sub-lease the vessel to third parties, participate in regattas or any misuse.

 

The customer should also be aware that he will not be able to navigate or operate the vessel under the influence of alcohol or any other illegal drug or substance.

 

Towing any other vessel, such as kayaks, jet-ski, surfboards, speedboats, sailboats, etc. is prohibited.

 

If assistance is requested by another vessel, the client will only be responsible for rescuing the human lives involved, immediately reporting what happened, to receive further instructions on how to proceed in this case.

 

The customer must complete a list with the name of all the crew members who will participate in the charter. The number of crew members cannot exceed the vessel's certification.

 

No animals are allowed on board.

 

It is forbidden to use a barbecue, to smoke inside the boat cabin, to use incense and candles due to the risk of fire and damage to the sailboat.

5 - DELIVERY OF THE SAILBOAT TO THE CLIENT

 

The customer will receive the vessel at the base of the Delta Yacht Charter in Porto Bracuhy, at the agreed date and time. During the delivery of the vessel, the customer must carefully examine the conditions of the vessel and the contracted equipment, according to the inspection term presented, dating and signing the same.

 

Any possible complaints or discontent must be notified before the charter starts. Defects not detected at the time of delivery, as well as those that may occur during the charter, do not give the customer the right to request reductions or indemnities in the amounts paid.

 

For security reasons, the customer will leave the port accompanied by a Delta Yacht Charter pilot until close to the exit of the marina channel. The delivery of the vessel's command to the customer will take place at this moment, when the pilot will then leave the vessel.

6 - SAILBOAT RETURN TO THE BASE OF THE COMPANY

 

The company must be notified by the client 15 minutes before the vessel approaches the channel entrance. A Delta Yacht Charter pilot will then be dispatched to the scene to safely guide the vessel and crew to the dock.

 

The customer has the obligation to return the vessel to the base of the Delta Yacht Charter, on the date and time established in the contract.

 

If there is an interest in extending the charter, the customer should contact the company to check the vessel's availability and value.

 

If the customer does not return the vessel at the time and date agreed in the contract without DYC's agreement, the client will pay a pro-rata rental fee (minimum the amount of a daily insurance with no fraction) and so on for a day of delay.

 

The sailboat will be delivered with a full tank, with an autonomy of approximately 30 hours. The engine time will be charged according to the hour meter, marked on departure and on arrival. The average is 4 liters per hour. If there is a need to refuel (save the note so we can deduct the amount), the only fuel allowed is Diesel Verana from the BR gas station. Pay attention to the correct filling nozzle indicated on the cover. If in doubt, contact the company.

 

It is the customer's responsibility to verify that all personal belongings of the crew have been landed.

 

Based on the Inspection Term, signed on the delivery of the vessel, a new inspection will be carried out with the customer to verify the good condition of all equipment. Damage caused by the client, the deposit will be retained until the budget of the real value.

7 - INSURANCE

 

Mandatory insurance covers the value of the vessel in the event of total loss.

 

Charged per night of charter at the rate of R $ 120.00, limited to R $ 600.00.

 

Average insurance deductible is R $ 25,000.00.

8 - CANCELLATIONS

 

A) Cancellations by the customer:

 

​ We do not reschedule charters.

 

Cancellations up to 31 days before the departure date: 

A fine of 20% of the total charter amount.

 

Cancellations between 21 and 30 days before the departure date: 

A fine of 35% of the total charter amount.

 

Cancellations less than 20 days before the charter date:

The amount already paid will be retained as a “reservation deposit”

(a fine of 50% of the total charter amount).

 

 

B) Cancellations by the company:

 

In the event of unforeseeable circumstances or force majeure, in accordance with the law, which prevents the vessel from starting or repairing it during the charter, the company is authorized to cancel the lease, by means of the pure and simple refund to the customer, of the deposits made by him or by mutual agreement set a new date for the lease, without the right of the client to indemnity of any other nature.
